Acceptance of Terms
Agreement
By accessing or using WiserCal (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying customers.
Modifications
We reserve the right to update these Terms at any time. We will notify you of material changes by email or via a prominent notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Additional Terms
Certain features or services may be subject to additional terms presented at the time of use. Those additional terms are incorporated into these Terms by reference.
Your Account
Eligibility
You must be at least 18 years of age to use WiserCal. By using the Service, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at info@wisercal.com if you suspect unauthorized access to your account.
One Account Per Business
WiserCal accounts are created by our team for a specific business after a demo request. Each business maintains one account. Misuse of the account or attempts to circumvent these Terms may result in account termination.
Account Termination
You may request account deletion at any time by contacting us at info@wisercal.com. We will process your request promptly and confirm once your account has been removed. We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or remain inactive for more than 12 consecutive months.
Use of the Service
Permitted Use
WiserCal is provided for lawful business purposes, including hosting your business page, managing your availability, and taking appointment bookings from your customers.
Prohibited Conduct
You may not use the Service to: (a) send unsolicited communications or spam; (b) impersonate any person or entity; (c) collect personal information about others without consent; (d) transmit harmful, offensive, or illegal content; (e) attempt to gain unauthorized access to any part of the Service or its related systems; (f) use automated tools to scrape, crawl, or extract data from the Service.
Fair Use
We reserve the right to throttle or suspend accounts that place excessive load on our infrastructure beyond normal usage patterns, as determined at our reasonable discretion.
Subscriptions and Payment
Free Month
New accounts include one free month, set up for you by the WiserCal team. After the free month ends, continued use of the Service requires an active paid subscription. There is no permanent free tier.
Paid Plans
After the free month, WiserCal offers three paid plans, all priced in Pakistani Rupees (PKR): a monthly plan paid in advance every month, a yearly plan paid in advance once a year, and a lifetime plan paid as a single one-time amount. We arrange payment with you directly and will tell you how to pay before each period begins. We do not store your card details and nothing is charged automatically.
Cancellation and Refunds
You may cancel a monthly or yearly plan at any time by contacting us at info@wisercal.com. If you are not satisfied, you may request a full refund within 30 days of your payment date. This 30 day refund window also applies to the lifetime plan, calculated from the date of purchase. Refund requests after 30 days will not be accepted. We issue refunds directly to you. After cancellation, you keep access until the end of the period you have already paid for.
Price Changes
We may change our prices with at least 30 days' notice. A price change takes effect at the start of your next payment period and does not affect a lifetime plan already purchased. If you disagree with a price change, you may cancel before it takes effect.
Taxes
You are responsible for any applicable sales, use, VAT, or similar taxes. Where required by law, we will collect and remit such taxes on your behalf.
Content and Intellectual Property
Your Content
You retain full ownership of all content you submit to WiserCal, including your business page content, services, and booking types. You grant us a limited, non-exclusive license to host, display, and transmit your content solely as necessary to provide the Service.
WiserCal IP
The Service, including its design, code, trademarks, logos, and all related intellectual property, is owned by WiserCal and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
Feedback
If you provide us with feedback, suggestions, or ideas about the Service, you grant us an irrevocable, royalty-free license to use that feedback in any manner. We are not obligated to compensate you for feedback.
Privacy
Privacy Policy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
Your Customers' Data
When your customers book appointments through your WiserCal page, we store their details on your behalf. You are responsible for what you ask them for and how you use it. We process that data only to run the booking service for you.
Disclaimers
As-Is Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Availability
We work to keep WiserCal available at all times, but we do not guarantee any specific level of availability. Scheduled maintenance, emergency fixes, and events beyond our reasonable control may result in downtime.
Limitation of Liability
Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISERCAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Cap on Damages
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the total amount you paid to WiserCal in the 12 months prior to the event giving rise to the claim, or, if you hold a lifetime plan, the amount you paid for that plan.
Essential Basis
The limitations above reflect an allocation of risk between the parties and are an essential element of the basis of the bargain between us. They shall apply even if any remedy fails of its essential purpose.
Governing Law & Disputes
Governing Law
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.
Dispute Resolution
Before filing a formal claim, you agree to contact us at info@wisercal.com and attempt to resolve the dispute informally. We will make reasonable efforts to address your concern within 30 days. If the dispute cannot be resolved informally, it shall be submitted to the competent courts of Lahore, Pakistan.
